Teen did not do community work

1:39pm Thursday 7th August 2008

A KIDDERMINSTER teenager involved in "a nasty" street assault failed to carry out unpaid work imposed by a judge, Worcester Crown Court heard.

Scott Mackellar, 18, of Queen Elizabeth Road, Kidderminster, was given 120 hours work a year ago during a 12-month community order.

But his job interferred with the work and he only completed 42 hours, said barrister Simon Phillips, acting for the probation service.

He said the order was unworkable and Judge Patrick Thomas QC revoked it.

The judge told Mackellar he was lucky not to be sent to prison and, instead, imposed an extra 10 hours of unpaid work.

He added: "You prioritised paid work over unpaid work. That is understandable but not forgiveable.

"It was a nasty assault, loutish behaviour in the street. This is your last chance."

Cathlyn Orchard, defending, said Mackellar was now unemployed and motivated to complete the court order.
